Hereinafter, "BasketIQ".

Through the Web Site, BasketIQ provides you with information about its activity, as well as the possibility of contacting you to request additional information and/or contract its services in accordance with the terms and conditions that, in any case, will be made available to you prior to contracting them, for your reading and acceptance in case of conformity.
We remind you that the services offered by BasketIQ may only be contracted by natural or legal persons who carry out an activity related to sport, with purposes linked to their commercial activity, business, trade or profession, in accordance with the provisions of the Contracting Conditions.
Likewise, through the Website, access is provided to the "BasketIQ Software" which consists of a SaaS (Software as a Service) cloud solution that allows the user who contracts the service and who is provided with access codes (user and password) to use the service consisting of the sports management of basketball teams with the following functionalities:
- Creation of user profiles, being able to establish filters by Users.
- Registration and management of players (individual record, status, evolution).
- Calendar: for the planning of the team/s, availability of playing/training fields, being able to establish filters by users.
- Whiteboard: for the creation of training exercises and plays.
- Season planning: for annual, monthly, weekly or daily planning of training sessions and matches.
- Exercise database: exercises classified and organised with a whiteboard, descriptions and videos.
At present it is not possible to purchase the "BasketIQ Software" electronically. For this purpose, you will have to contact BasketIQ.
Use of the Website:
By accessing and/or using the Website, you will have the condition of user, and you are obliged to comply with the provisions of this document.
3.1. Language:
The content provided on the Website can be found in Spanish, French, Swedish and English.
3.2. Proper use of the Website:
With the access and/or use of the Web Site, you are obliged at all times to make an adequate use of the resources that BasketIQ places at your disposal, in accordance with the provisions herein and respecting at all times the morality, the public order, the good customs and the law in force, without causing damages to the physical and logical systems of BasketIQ or of third parties.
You will use the Web Site under your exclusive responsibility for the purposes foreseen by BasketIQ and through the functionalities made available by BasketIQ. Any other use of the Website will entitle BasketIQ to suspend your access to the Website and/or the use of Oralvision.
The use of screen scraping techniques, web scraping or any other programming technique (or of any other kind) that allows the extraction of information or data hosted, stored or accessible on the Website is expressly forbidden without BasketIQ's express written authorisation.

In the event that through the Website your participation is allowed through the publication of comments or the generation of contents, it is absolutely forbidden to disseminate contents or propaganda of an illicit nature, such as racist, xenophobic contents, of apology of terrorism, infringing human rights, or inciting to hatred, violating the dignity of the person, or of a slanderous, libellous nature or against public order or security or infringing intellectual or industrial property rights.

In any case, BasketIQ will not be responsible for the opinions expressed or for the contents published by the users through the forums, chats, blogs or other participation tools that, in its case, may be created, except as expressly provided by the applicable regulations.
Interruptions in the operation of the Web Site:
BasketIQ does not guarantee that there will be no interruptions or errors in the access to the Web Site. Nevertheless, there is a firm commitment, as soon as BasketIQ has knowledge of such incidences, to carry out all the actions aimed at its reestablishment or repair, except for the concurrence of causes beyond BasketIQ's control that make it impossible or difficult its execution.
In case you contract the BasketIQ Software, the Service Level Agreement (SLA) established in the contracting conditions will be applied.
Exoneration of responsibility:
Unless otherwise expressly imposed in these conditions or in the applicable legislation and, exclusively, to the extent and extent to which it is imposed, BasketIQ will only be liable for the direct damages suffered by the user and only when they have been caused by a cause directly attributable to BasketIQ.
BasketIQ will not assume any responsibility:
- For the problems derived from the lack of access or from the problems inherent to the connectivity to Internet or to the electricity networks when these had their origin in causes beyond its control or causes that could not have been foreseen by the parties or that, even being foreseeable, BasketIQ has made all reasonable efforts to avoid them or that were considered as fortuitous causes or of force majeure.
- For damages of any nature that may be caused to the user's physical and logical systems or to the files or documents stored therein, as a consequence of the presence of virus in the user's device or of a malfunction or use of a non-updated version of the user's browser.

- For actions or omissions directly attributable to the user or to third parties directly dependent on the user.
- For the fact that the service does not meet the user's expectations or does not adjust to his needs, for patrimonial gains or losses in the user's activity, as it is up to the user to assess whether it is useful for his purposes before its use.
- For non-compliance with the obligations incumbent on the user.
Intellectual and Industrial Property:
The totality of the elements and/or contents published on the Website have been created by BasketIQ or it has a licence or authorisation for their use.
Therefore, all those elements and/or contents (such as: images, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, applications necessary for its operation, access and use, etc.) and the exploitation rights over them, are the exclusive property of BasketIQ.
The reproduction, distribution, public communication -including its modality of making available- and the transformation, of the totality or part of the contents of the Web Site, in any support and by any technical means, without the previous express and written authorisation of BasketIQ, is totally forbidden.
In case of carrying out any of the above-mentioned prohibited actions, those exclusive rights of intellectual or industrial property that correspond to BasketIQ will be infringed.
